TERMS AND CONDITIONS.

The following terms outline the agreement between Client Name and Company Name for the delivery of game development services. These terms are designed to ensure transparency, protect both parties, and support a smooth project experience.

1. PAYMENTS AND CANCELLATIONS.

Company Name begins work once the initial project deposit is received. The deposit typically ranges between Initial Deposit Percentage of the total project cost, as agreed upon in the final proposal. All payments shall be made through Mode of Payment.

If Client Name cancels or pauses the project before completion, a cancellation fee may apply. This fee will reflect the work completed and any non-recoverable costs incurred up to the date of cancellation. We will always make reasonable efforts to minimize any such costs.

In the event of overdue or unpaid invoices, Company Name may pause active development until payment is received.

2. LIABILITY LIMITATIONS.

Company Name will execute the project with professional skill, care, and reasonable precautions. However, certain limitations apply:

(a) We cannot guarantee the absolute accuracy, uninterrupted performance, or error-free operation of software or third-party tools.

(b) We are not liable for losses arising from delays, omissions, or disruptions caused by factors outside our control.

(c) Liability does not extend to damage to artwork, content, code, or other materials provided by the client.

(d) Except in cases of personal injury or death caused by negligence, Company Name will not be responsible for any indirect losses, including reduced profit or claims by third parties.

(e) We are not responsible for performance issues caused by third-party services, hosting platforms, or external integrations.

3. PRODUCTION SCHEDULE.

Our team is committed to delivering the project on time. However, delivery dates may need to be adjusted due to unforeseen circumstances, such as technology dependencies, scope changes, or delays in client feedback or approvals.

We will communicate promptly if a timeline shift becomes necessary, and both parties will collaborate to realign expectations.

4. DELIVERY AND APPROVALS.

Projects are completed in structured stages. Work on each stage begins once the prior stage is approved and the corresponding payment is received.

Upon final completion:

(a) A review version of the game will be shared with the client for approval.

(b) After approval, deployment to the destination server or app platform will be completed.

(c) Transfer of source files, documentation, and ownership rights occurs upon full payment.

Company Name may feature the completed project as part of our portfolio unless the client requests otherwise in writing before project completion.

5. DISCLAIMER.

The client acknowledges that no computer system or software can be made entirely stable, secure, or guaranteed and that the company cannot guarantee the stability, safety, or security of the client’s network or data.

The company warrants that the services will be provided in a workmanlike manner and in conformity with generally prevailing industry standards. The client is solely responsible for implementing and monitoring appropriate operational and security procedures, as well as for making regular backups of all data.

While we follow industry standards for development, testing, and security, the client acknowledges:

(a) No software system can be guaranteed to be completely secure, stable, or error-free.

(b) The client is responsible for maintaining appropriate backup schedules, operational security measures, and post-deployment monitoring.

Company Name warrants that services will be delivered professionally and in alignment with prevailing industry practices. This warranty is exclusive and replaces all other warranties, whether implied or expressed.
